Terms of Service

These Terms of Service ("Terms") govern your access to and use of the conversational survey platform and related services (the "Service") provided by Reki App ("Reki", "we", "our", or "us").

By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you represent that you have the authority to bind that company to these Terms.

1. The Service

Reki provides an online platform that allows users ("Creators") to:

• Build and manage conversational AI-powered surveys.
• Share surveys with respondents.
• View analytics and export collected data.

Respondents do not need an account to participate. These Terms apply to Creators only.

2. Accounts

• You must be at least 18 years old to create an account.
• You agree to provide accurate information during registration and keep your login credentials secure.
• You are responsible for all activity under your account.

3. Use of the Service

You agree:

• Not to use the Service for unlawful, harmful, abusive, or infringing purposes.
• Not to upload or collect sensitive personal data (e.g., health data, financial data) without ensuring you have a lawful basis and consent from respondents.
• Not to attempt to interfere with the security or integrity of the Service.

4. Respondent Data

• You own the responses collected from your surveys.
• For data protection purposes, you are the "data controller" for your respondents' data. Reki processes that data as your data processor.
• You are responsible for providing respondents with any legally required notices or consents.

5. Payments, Credits, and Refunds

Purchases and Credits

Our services operate on a credit-based system. Credits can be purchased through our platform using the payment processor Stripe.

Credits are linked to your account and may be used to activate surveys or other features.

Pricing and Currency

All prices are listed and charged in United States Dollars (USD). If you use a payment method denominated in another currency, your payment provider may apply currency conversion rates and additional fees.

We reserve the right to adjust pricing at any time. Updated prices will be displayed on the billing page prior to purchase.

Refunds

All purchases are final and non-refundable, except where required by applicable law.

If you believe there has been an error in billing, please contact us at billing@reki.com.au within 14 days, and we will investigate the issue.

Credit Expiration

Credits purchased through the Service do not currently expire. However, we reserve the right to introduce an expiration policy in the future. If we do so, we will provide you with reasonable advance notice, and any existing unused credits will remain valid for at least 12 months from the date of purchase.

Stripe as Payment Processor

Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service: https://stripe.com/legal.

We do not store or have access to your complete payment card details.

6. AI-Powered Features and Disclaimers

• Parts of the Service use AI models provided by OpenAI.
• AI-generated content may be inaccurate, incomplete, or inappropriate.
• You are responsible for reviewing all AI-generated content before using or relying on it.
• AI-generated outputs are provided "as is" without warranties of accuracy or fitness for purpose. You are solely responsible for any reliance on or use of such outputs in your surveys or business activities.
• By using the Service, you also agree to OpenAI's use of your data for the purpose of generating responses (see our Privacy Policy).

7. Intellectual Property

• You retain ownership of your surveys and collected data.
• Reki retains all rights to the platform, software, and related intellectual property.
• You may not copy, modify, or distribute the Service except as permitted by these Terms.

8. Service Availability

• We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation.
• We may modify, suspend, or discontinue parts of the Service without liability.

9. Termination

• You may stop using the Service at any time.
• We may suspend or terminate your account if you breach these Terms or if we reasonably believe your use poses a risk to others.

10. Limitation of Liability

To the fullest extent permitted by law:

• Reki will not be liable for indirect, incidental, or consequential damages.
• Reki's total liability will be limited to the amount you paid for the Service in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Reki from claims or losses related to your use of the Service, your surveys, and any violation of these Terms.

12. Changes to the Terms

We may update these Terms occasionally. If we make significant changes, we will notify you by email or through the Service.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved exclusively in the courts of New South Wales.

14. Analytics and Monitoring

To operate and improve the Service, we use third-party providers such as PostHog (analytics) and Sentry (error monitoring). These tools collect technical and usage data, including events, performance metrics, and error reports. By using the Service, you acknowledge and agree that such data may be collected and processed for the purposes of maintaining, securing, and enhancing the Service.
